Can KakaoTalk chats be submitted as evidence?

Submitting a chat as material is common in itself. Whether it is accepted, and how far it is trusted, is for the court to decide, looking at who the other party is, when the chat took place and whether the surrounding flow is consistent. convokeep does not promise admission.

In what form should text information be submitted?

<!-- NEEDS-COMPLIANCE-LEGAL --> Article 120 of the Korean Rules of Civil Procedure says that text information stored on a computer disk or similar medium can be submitted as a printout made readable, and that when the court orders it or the other party requests it, the person who entered the information and the date and time, and the person who printed it and the date and time, must be stated. We could not open this provision directly in the original text of the Ministry of Government Legislation, so check the current wording on the Korea Law Information Center before submitting.

In what order should I prepare?

  1. Export the chat from the device that holds it.
  2. Keep the exported .txt file separately, without editing it.
  3. Organize it into a PDF with dates and page numbers, and keep the hash values of the original and the PDF together.
  4. Whether you need the whole content or only a certain period, follow your lawyer or the court's guidance.

May I submit only the parts I choose?

You can choose a date range, but looking at only part of a chat can lead to the argument that the surrounding context is missing. Even when you submit selected parts, keep the complete file separately.

Should I keep the original phone too?

If a dispute arises, the original may be needed, so it is safer not to delete chats and to keep the device and the exported file as they are.

Can I submit a conversation I was not part of?

A chat you took part in and material obtained by secretly opening someone else's phone are different matters. The latter may carry separate legal risks, so always talk to a lawyer first.
